Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TargetByTitle website at targetbytitle.com (the "Site") and the TargetByTitle service, operated by SCAIL LLC ("Company," "we," "us," or "our"). By accessing or using the Site or the service, you agree to be bound by these Terms. Delivery of audiences into an advertising account is additionally governed by the TargetByTitle Agency Agreement, which you accept online before your first audience is delivered.

1. Use of the Site

You may use this Site for lawful purposes only. You agree not to use the Site in any way that violates applicable laws or regulations, or to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.

2. Intellectual property

All content on this Site — including text, graphics, logos, images, audience profiles, and software — is the property of SCAIL LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission, except that audience profiles we prepare for you may be shared with your clients in the course of your business.

3. Audience profiles and audiences

Audience profiles are estimates prepared from licensed professional data at the time of the request. Counts are pre-match and the audience size shown by an advertising platform will differ. Audiences delivered to an advertising account are licensed for use by the named advertiser in that account and may not be exported, resold, or used to identify individuals. You remain responsible for the content of your advertisements, for selecting the correct advertising category (including Meta's Employment Special Ad Category), and for compliance with applicable employment and advertising law. Our compliance certifications describe how audiences are constructed and do not extend to your advertisements or hiring process.

4. Inquiries and communications

When you submit a job posting, inquiry, or other information through our Site, you agree to provide accurate and complete information and represent that you are authorized to request advertising audiences for the posting you submit. We may use the information you provide to respond to your request and for related business purposes as described in our Privacy Policy.

5. Fees and cancellation

Audience subscriptions are billed monthly per audience at the price shown on the Site at the time of activation and continue until cancelled from your dashboard. Display flights are prepaid. Removing our access to an advertising account does not cancel a subscription; cancelling from your dashboard does. Prices may change with notice; changes do not affect the current billing period.

6. SMS communications

By providing your phone number and opting in to SMS notifications, you agree to receive automated text messages from SCAIL LLC related to your account activity, including audience delivery notifications and alerts. Standard message and data rates may apply. You may opt out at any time by texting STOP, or text HELP for assistance. SCAIL LLC may modify or discontinue the SMS service at any time and is not responsible for delayed or undelivered messages caused by your wireless carrier.

7. Third-party links and platforms

The Site may contain links to third-party websites, and the service delivers audiences into third-party advertising platforms. These are provided for your convenience. We have no control over third-party sites or platforms and accept no responsibility for them, for changes to their policies, or for any loss or damage that may arise from your use of them.

8. Disclaimer of warranties

THE SITE, THE SERVICE, AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY AUDIENCE WILL PRODUCE A PARTICULAR ADVERTISING RESULT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAIL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to the Site. Your continued use of the Site or the service after any change constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict-of-law principles.
